Terms of Service

Effective date: September 7, 2026

These Terms of Service (“Terms”) govern your use of mitigatemyhouse.com (the “Site”) and the referral service offered through it (the “Service”), both operated by MitigateMyHouse (“MitigateMyHouse,” “we,” “us,” or “our”). By using the Site or submitting a request, you agree to these Terms. If you do not agree, do not use the Site.

What MitigateMyHouse is, and what it is not

MitigateMyHouse is a referral service. We collect information from homeowners about wildfire mitigation and defensible-space work and pass that information to independent contractors who may be able to perform it.

We are not an insurance company, insurance agency, insurance producer or broker, public adjuster, contractor, engineer, inspector, or law firm. We do not perform mitigation work. We do not sell, place, bind, adjust, or advise on insurance. We do not contact your insurer on your behalf, and we do not represent you in any dealing with your insurer.

Eligibility

You may use the Service only if you are at least 18 years old, are located in the United States, and either own the property described in your request or are authorized by the owner to request work on it and to consent to contact about it.

How the Service works

  • You submit a request describing your property and the work you think you need.
  • We send that request to as many as three independent contractors who serve your area.
  • Those contractors contact you directly. Any quote, contract, schedule, price, and warranty is between you and the contractor.

We do not guarantee that any contractor will contact you, that any contractor is available in your area, that you will receive three responses, or that you will receive any response at all. We may decline or discontinue a request for any reason.

No guarantee of any insurance outcome

Completing mitigation work does not guarantee that your policy will be reinstated or renewed, that your premium will decrease, or that you will obtain coverage from any insurer. Underwriting decisions belong to insurers, and insurers apply their own criteria and their own risk models. Nothing on this Site is a promise, prediction, or warranty about how any insurer will act.

Contractors are independent

Contractors in our network are independent businesses. They are not our employees, agents, partners, joint venturers, or franchisees, and we do not control them.

We ask contractors to confirm that they hold the licenses and insurance their state requires and that they carry general liability coverage. We do not, and cannot, continuously monitor licensing status, insurance coverage, work quality, safety practices, pricing, or scheduling.

Before you sign anything or let anyone begin work, verify the contractor’s license and insurance yourself with the appropriate state agency. In Oregon, that is the Construction Contractors Board. Other states have their own licensing bodies.

We do not recommend, endorse, certify, rank, rate, or guarantee any contractor, and inclusion in our network is not an endorsement. We are not a party to any agreement between you and a contractor and have no responsibility for the work performed, the price charged, or any dispute that arises.

How we are paid

The Service is free to homeowners. Contractors pay MitigateMyHouse a flat referral fee for each request we send them. That fee does not change what a contractor charges you, and it is not a commission on your project.

Because we are paid by contractors, our matches are commercial referrals, not impartial recommendations. Which contractors receive your request depends on their service area, the work you requested, and their participation in our network — not on an independent assessment of which contractor is best for you.

Your responsibilities

  • Give accurate, current, and complete information in your request.
  • Do not submit anyone else’s information without their permission.
  • Confirm that you have authority to consent to contact at the phone number and email address you give us.
  • Evaluate contractors, contracts, and prices yourself before you commit.
  • Use the Site only for lawful purposes.

Consent to be contacted

By checking the consent box and submitting the form, you agree that MitigateMyHouse and up to three contractors we select may contact you at the phone number and email address you provided — including by automatic telephone dialing system, prerecorded or artificial voice, and SMS text message — about your request. Consent is not a condition of purchasing any goods or services. Message and data rates may apply. Reply STOP to stop texts from a sender, or HELP for help. See our Privacy Policy for how to withdraw consent.

Content on this Site is information, not advice

We describe state statutes, insurance notice requirements, mitigation standards, and typical costs to help you understand your situation. This material is general information, may become outdated, and may not fit your circumstances. It is not legal advice, insurance advice, engineering advice, or a professional assessment of your property. Cost ranges are estimates, not quotes. For advice about your own situation, consult a licensed professional; for questions about an insurance notice, contact your state insurance regulator.

Prohibited uses

You agree not to scrape, crawl, harvest, or bulk-collect content or data from the Site; submit false, fraudulent, or automated requests; interfere with or attempt to gain unauthorized access to the Site or its systems; use the Site to send spam or unlawful communications; or reproduce or republish substantial portions of the Site’s content without permission.

Intellectual property

The Site and its content — text, layout, graphics, and the MitigateMyHouse name and logo — are owned by MitigateMyHouse and protected by intellectual property law. You may view and print pages for your own non-commercial use. All other rights are reserved.

Third-party links

The Site links to outside resources such as state agencies and fire districts. We do not control those sites, do not endorse them, and are not responsible for their content or practices.

Disclaimer of warranties

THE SITE AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT INFORMATION ON IT IS ACCURATE OR CURRENT, OR THAT ANY CONTRACTOR WILL CONTACT YOU, PERFORM SATISFACTORILY, OR BE SUITABLE FOR YOUR PROJECT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MITIGATEMYHOUSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF INSURANCE COVERAGE, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICE, OR ANY CONTRACTOR — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS (USD 100).

Some states do not allow the exclusion or limitation of certain damages. In those states, the exclusions above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold harmless MitigateMyHouse and its owners, officers, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, information you submitted about another person without authorization, or any dispute between you and a contractor.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms, the Site, or the Service must be brought exclusively in the state or federal courts located in Whatcom County, Washington, and you consent to the personal jurisdiction of those courts.

Nothing in these Terms prevents you from bringing a claim in small claims court, or from filing a complaint with a state attorney general, consumer protection office, insurance regulator, or contractor licensing board.

Changes to these Terms

We may update these Terms. When we do, we will change the effective date at the top of this page. Your continued use of the Site after a change takes effect means you accept the revised Terms.

Severability and entire agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in effect. These Terms and the Privacy Policy are the entire agreement between you and MitigateMyHouse regarding the Site and the Service. Our failure to enforce a provision is not a waiver of it.
